The Public Safety and Private Wireless Division (Division) of the Wireless Telecommunications Bureau has before it a motion for extension of time (Motion) to file a protest of our Order on Reconsideration and Order on Modification (Order), 1 filed by the Bergen County, New Jersey Police Department (Bergen) on June 2, 2000. 2 Bergen requests that we extend the time for filing a protest to Order to forty- five days, from June 12, 2000 to July 27, 2000. 3 On June 6, 2000 the Police Department 1 Application of Greco Cousins Concrete Corp. for Authorization to Operate a Private Land Mobile Radio Station in the Industrial Radio Service and Bergen County Police Department to Operate Frequency Pair 477/ 480.5125 MHz Under Call Sign WPLR685, Order on Reconsideration and Order on Modification, DA 00- 929 (WTB PSPWD rel. May 18, 2000) (Order). 2 Bergen County, New Jersey Police Department Motion for Extension of Time to File Protest of Commission Order (Motion) (filed June 2, 2000). 3 Motion at 1. 1 Federal Communications Commission DA 00- 1289 2 of the City of New York filed comments in support of Bergen’s Motion. 4 2. In the Order, the Division concluded that the grant of Bergen’s license was defective. 5 Accordingly, the Division reinstated Greco Cousins Concrete Corp. ’s (Greco) application for authorization of a new station in the Industrial Radio Service for use on frequency pair 477/ 480.5125 MHz to pending status 6 and proposed to delete frequency pair 477/ 480.5125 MHz from Bergen’s Station WPRL685. 7 3. The Bergen County Police Department serves an area with a population of 875,000. 8 Bergen includes a Patrol Division, Water Search and Recovery Team, Bomb Team, Hostage Negotiations Team, Canine Squad and Criminal Investigation Division. 9 According to Bergen, its Communications Division covers “all facets of county government, including police, fire, emergency management, and transportation.” 10 4. Bergen states that the Order proposes to terminate critical public safety communications and vest authorization for the assigned frequencies in Greco. 11 Bergen further states that this action will endanger the health and safety of law enforcement officers in Bergen County and throughout the New York Metropolitan area, thus jeopardizing fundamental public safety operations. 12 Bergen also states that no detriment will accrue by granting an extension of time to file a protest of the decision, and that such an extension will afford Bergen an opportunity to review and present its position to the Commission. 13 While the Commission does not routinely grant motions for extension of time, we believe that Bergen has presented good cause for approval of such a motion. 14 We therefore conclude that a grant of the Motion would be in the public interest. 5. Accordingly, IT IS ORDERED that, pursuant to Section 4( i) of the Communications Act of 1934, as amended, 47 U. S. C. § 154( i), and Section 1.46 of the Commission’s Rules, 47 C. F. R. § 1.46, the motion for extension of time to file a protest of the Order on Reconsideration and Order on 4 Comments of the Police Department of the City of New York (filed June 6, 2000).
