In this Forfeiture Order (“ Order”), we issue a monetary forfeiture in the amount of twelve thousand dollars ($ 12,000) against Morradio, Inc., licensee of AM Station WLMA, Greenwood, South Carolina, for willful and repeated violation of Sections 11. 35( a), 73.1690( b), and 73.3538( a)( 4) of the Commission’s Rules. 1 The noted violations involve Morradio’s changes in its antenna structure location without a construction permit and failure to install and maintain Emergency Alert System equipment. 2. On January 24, 2000, the District Director of the Atlanta Field Office issued a Notice of Apparent Liability for Forfeiture (“ NAL”) in the amount of twelve thousand dollars ($ 12,000) to Morradio, Inc. for the referenced violations. 2 Morradio has not filed a response. Based on the information before us, we affirm the assessment of a monetary forfeiture in this matter. 3. ACCORDINGLY, IT IS ORDERED that, pursuant to Section 503( b) of the Act, 3 and Sections 0.111, 0. 311 and 1.80( f)( 4) of the Commission's Rules, 4 Morradio, Inc., IS LIABLE FOR A MONETARY FORFEITURE in the amount of $12,000 for willful violation of the provisions of Sections 11. 35( a), 73.1690( b), and 73. 3538( a)( 4) of the Commission’s Rules. 4. Payment of the forfeiture shall be made in the manner provided for in Section 1.80 of the Commission’s Rules 5 within 30 days of the release of this Order. If the forfeiture is not paid within the period specified, the case may be referred to the Department of Justice for collection pursuant to Section 504( a) of the Act. 6 Payment may be made by credit card through the Commission's Credit and Debt Management Center at (202) 418- 1995 or by mailing a check or similar instrument, payable to the order 1 47 C.
