The Commission may return or dismiss this application if it is found, upon further examination, to be defective or not in conformance with the Commission's rules. In addition, the application listed in Attachment A is accepted conditioned upon the resolution of the request for waiver contained therein. Petitions to deny the application listed in Attachment A must be filed no later than September 5, 2000, which is ten (10) days after the date of this Public Notice. See 47 C. F. R. §§ 1.4 and 73.5006( b). Oppositions to a petition to deny must be filed no later than five (5) business days from the filing date for petitions to deny. Replies to the opposition must be filed no later than five (5) business days from the filing date for oppositions. See 47 C. F. R. §§ 1.4 and 73.5006( c). All pleadings should reference the specific file number of the individual application. An original and four copies of all pleadings must be filed with the Commission's Secretary, Magalie Roman Salas, Office of the Secretary, Federal Communications Commission, 445 Twelfth Street, S. The winning bidder will be required to pay the balance of its winning bid in a lump sum payment within ten (10) business days following the release of that public notice. A construction permit will be awarded upon the full and timely payment of the winning bid and any applicable late fees. See 47 C. F. R. § 73.5003( c).
