Attachment A lists all vacant FM allotments that will be included in Auction No. 37, including the eight additional vacant FM allotments. Please note that the eight additional vacant FM allotments have been inserted into Attachment A alphabetically by state and that the Market Numbers identified in the attachment to the Auction 37 Comment Public Notice 2 have been revised to reflect the addition of these eight vacant FM allotments. This Public Notice also seeks comment on procedural issues related to the auctioning of these additional FM broadcast construction permits in Auction No. 37. We seek comment on the proposed minimum opening bids and upfront payments for the eight additional vacant FM allotments listed above. In the Auction No. 37 Comment Public Notice, the Bureaus set forth and sought comments on the following proposals relating to auction structure and bidding procedures: (1) simultaneous multiple round auction design; (2) upfront payments and initial maximum eligibility; (3) activity rules; (4) activity rule waivers; (5) information relating to auction delay, suspension or cancellation; (6) round structure; (7) reserve price or minimum opening bid; (8) minimum accepted bids and bid increments; (9) information regarding bid withdrawal and bid removal; and (10) the stopping rule. The Bureaus propose to utilize the same auction structure and procedures for the additional eight FM broadcast construction permits that it will utilize for the auction of the other FM broadcast construction permits in Auction No. 37. By this Public Notice, we seek comment on these auction structure and bidding procedure proposals as they relate to the eight additional vacant FM allotments listed above. Comments which address minimum opening bids, upfront payments, auction structure and/ or bidding procedures as they relate to the eight additional vacant FM allotments listed above are due on or before October 13, 2000, and reply comments are due on or before October 23, 2000. 3 To file formally, parties must submit an original and four paper copies to the Office of the Secretary, Federal Communications Commission, 445 12th Street, S.
