With this Public Notice we redesignate the ex parte status of the applications in the first Ka- band satellite application processing round. We also clarify that we will continue to treat the pending applications in the second Ka- band processing round as a permit- but- disclose proceeding. Under the Commission’s ex parte rules, the applications in the first Ka- band processing round were treated as a restricted application proceeding. See §§ 1.200( d) and 1.1208. These applicants received licenses in May 1997. The International Bureau established a cut- off for applications for the second Ka- band processing round and received several applications in December of 1997. When these applications were accepted for filing, the Commission redesignated the ex parte status for applications in the second- processing round from restricted to permit- but- disclose. See Public Notice Report No. SAT- 00012( 1999), released March 16, 1999. As a result of recent Bureau actions taken on the NetSat28 Company, L. L. C., MorningStar Satellite Company, L. L. C. and PanAmSat Licensee Corp. authorizations from the first processing round, seven orbit locations assigned in the first processing round are available for reassignment in the second Ka- band processing round. Applications for Review of the Bureau actions are pending. Because of the interrelated nature of these separate processing rounds, we find that it is in the public interest to redesignate the ex parte status of the first round Ka- band applications from a restricted to a permit- but- disclose proceeding. The Applications for Review filed by MorningStar, NetSat 28 and PanAmSat will therefore be treated as permit- but- disclose. For the reasons stated in the March 1999 Public Notice accepting the second- round applicants for filing, we will continue to treat the applications in the second Ka- band processing round as permit but disclose. Accordingly, ex parte presentations relating to either the first or second Ka- band application proceedings, are subject to the disclosure requirements set forth in Section 1.1206 of the Commission’s rules. 47 C. F. R. § 1.1206. This action is taken pursuant to authority found in section 4( i) and 303 of the Communications Act of 1934, as amended, 47 U. S. C. § 154( i) and 303; and pursuant to Sections 0.31, 0.241, 0.261, and 1.1200( a) of the Commission’s Rules. See 47 C. F. R. §§ 0.31, 0.241, 0.261 and 1.1200( a).
