On November 1, 2000, TCI Cablevision of California, Inc. (" TCI- C") and the San Mateo County Cable Television Authority (" SAMCAT") filed with the Commission a joint motion to withdraw appeals of local rate orders for the above captioned communities in California. TCI- C had filed with the Commission on October 21, 1996 a petition for reconsideration of Memorandum Opinion and Order, DA 96- 1541 released on September 19, 1996 by the Cable Services Bureau. In its motion, TCI- C states that it has reached an acceptable resolution of this matter with SAMCAT and request that the Petition for Reconsideration, as well as all subsequent filings related to this proceeding be withdrawn and dismissed without benefit of substantive Commission review. This withdrawal resolves all pending BST rate matters before the FCC involving TCI- C and SAMCAT. 2. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed by TCI Cablevision of California, Inc. and the San Mateo County Cable Television Authority IS GRANTED and the petition for reconsideration filed by TCI- C IS DISMISSED. 3. This action is taken by the Chief, Consumer Protection and Competition Division, Cable Services Bureau, pursuant to authority delegated by Section 0.321 of the Commission's rules. 47 C. F.
