C. 20554 DA 00- 2647 CABLE SERVICES BUREAU ACTION November 24, 2000 APPLICATION OF THE NETWORK NON- DUPLICATION, SYNDICATED EXCLUSIVITY, AND SPORTS BLACKOUT RULES TO SATELLITE RETRANSMISSION OF BROADCAST SIGNALS REQUIRING OMB APPROVAL EFFECTIVE AS OF NOVEMBER 29, 2000 On November 2, 2000, the Commission released a Report and Order (FCC 00- 388) adopting network non- duplication, syndicated exclusivity, and sports blackout rules for satellite carriers. These rules implement provisions contained in Section 1008 of the Satellite Home Viewer Improvement Act (SHVIA). This section created new Section 339 of the Communications Act of 1934, as amended. Section 339( b) directs the Commission to apply the network non-duplication, syndicated exclusivity, and sports blackout rules, previously applied only to cable television systems, to satellite carriers’ retransmission of nationally distributed superstations. Congress also requires the Commission to apply the sports blackout rule to satellite carriers’ retransmission of network stations, but only “to the extent technically feasible and not economically prohibitive.” SHVIA requires that the rules adopted to implement these provisions become effective November 29, 2000. Because the rules imposed new or modified information collection requirements, they could not become effective until approved by the Office of Management and Budget (“ OMB”) pursuant to the Paperwork Reduction Act of 1995, Pub. L. No. 104- 13. On November 22, 2000, the Commission received emergency approval from OMB for the information collections contained in the rules (OMB No. 3060- 0960). The Commission stated that the rules adopted in the Report and Order shall become effective November 29, 2000, provided that the order (or a summary thereof) and the rules had been published in the Federal Register and OMB emergency approval of the information collections had been obtained on or before that date. This Public Notice confirms that the Order and rules have been published in the Federal Register and that the Commission has received OMB approval for the information collections. Accordingly, the rules are effective on November 29, 2000.
