At the request of Cent ral Virginia Educat ional Telecommunicat ions Corporat ion (" CVETC"), licensee of noncommercial station WCVE- TV, NTSC Channel *23, Richmond, Virginia, the Commission has before it the Notice of Proposed Rule Making, 15 FCC Rcd 9445 (2000), proposing the substitution of DTV Channel *42 for station WCVE- TV's assigned DTV Channel *24. CVETC filed comments reaffirming its interest in applying for DTV Channel *42, if allotted. Capital Television Corporat ion (" Capit al"), permitt ee of Low- Power TV St at ion W42CH, Richmond, Virginia, filed comment s. 1 2. We believe the public interest would be served by the proposed substitution of DTV Channel *42 for DTV Channel *24 because it would eliminate the potential for interference between WTVR- DT, Channel 25, Richmond, Virginia, and station WCVE- TV's operation on DTV channel *24. In addition, the channel substitution would permit CVETC to operate- commonly owned DTV stations WCVE- DT and WCVW- DT, both located in Richmond, from a common antenna and reduce intermodulation effects between local channels 22, 23, 24, 25, and 26. 3. DTV channel *42 can be allotted to Richmond, Virginia, as proposed, in compliance with the principle community coverage requirements of Section 73.625( a) at reference coordinates ( 37- 30- 46 N. and 77- 36- 06 W.). In addition, we find that this channel is acceptable under the 2 percent criterion for de minimis impact that is applied in evaluating requests for modification of initial DTV allotments under Section 73.623( c)( 2) for Station WCVE- TV with the following specifications: DTV DTV power Antenna DTV Service State & City Channel (kW) HAAT (m) Pop. (thous.) 1 Capital states that CVETC's request to change channels will displace W42CH. However, Capital notes that it has filed an application for low- power displacement relief to operate on Channel 59. Capital states, if granted relief, it does not object to CVETC's proposal. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective January 16, 2001, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Richmond, Virginia 25, 26, *42, *44, 54 5 IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, Cent ral Virginia Educat ional Telecommunicat ions shall submit to t he Commission a minor change application for a construction permit (FCC Form 301) specifying DTV Channel *42 in lieu of DTV Channel *24 for station WCVE- TV. 6.
