C. 20554 DA 00- 2745 News media information 202/ 418- 0500 Fax- On- Demand 202/ 418- 2830 Internet: http:// www. fcc. gov ftp. fcc. gov Released: December 6, 2000 WIRELESS TELECOMMUNICATIONS BUREAU ANNOUNCES IT IS PREPARED TO GRANT 700 MHz GUARD BANDS AUCTION LICENSES AFTER FINAL PAYMENT IS MADE Auction Event No. 33 Report No. AUC- 33 (Auction No. 33) On September 21, 2000, the FCC completed its auction of 700 MHz Guard Bands licenses. 1 After a preliminary review of the FCC long- form applications (FCC Form 601), applications for 96 licenses were accepted for filing. 2 By this Public Notice, the Bureau announces that it is prepared to grant the applications for the 70 licenses listed in Attachment A of this Public Notice upon the full and timely payment of the remaining balance of each applicant's winning bid. Such payment must be received by the Commission within ten (10) business days of the date of this Public Notice (i. e., by December 20, 2000). See 47 C. F. R. § 1.2109( a). If a winning bidder fails to pay the balance of its winning bids in a lump sum by the applicable deadline, as specified by the Commission, it may pay the remaining balance within ten (10) business days after the payment deadline (i. e., by January 5, 2000), provided that it also pays a late fee equal to five percent of the amount due. See 47 C. F. R. § 1.2109( a). Applications not appearing in Attachment A remain under consideration by the Commission. A winning bidder listed on Attachment A who fails to pay the balance of its winning bid by the late payment deadline of January 5, 2000, will be considered in default and subject to the applicable default payments. See 47 C. F. R. §§ 1.2104( g), 1.2109( c). Such applicants will be assessed default penalties as prescribed by sections 1.2104( g) and 1.2109( c) of the Commission's rules. See 47 C. F. R. §§ 1.2104( g), 1.2109( c). Payment Instructions All payments must be made in U. S. currency in the form of a wire transfer. See 47 C. F. R. § 1.2107( b). No personal checks, cashier's checks or other forms of payment will be accepted. Wire transfer payments must be received by Mellon Bank no later than 6: 00 p. m. Eastern Time, December 20, 2000 (or 6: 00 p. m. Eastern Time, January 5, 2000, along with the five- percent late fee). Applicants should allow sufficient time for the wire transfer to be initiated and for the transmission to be completed prior to the deadline. On the FCC Form 159, applicants must use the same FCC Taxpayer Identification Number (TIN) used on their FCC Form 601s. When completing FCC Form 159, applicants must specify each license as a separate item. Applicants must type license number( s) in Block( s) 24A, 24B, 24C, and 24D (" FCC Code 2") of FCC Form 159. They must also type the auction number, "33," in Block( s) 23A, 23B, 23C, and 23D (" FCC Code 1"). As just noted, Form 159 provides sufficient boxes to list only four licenses. Applicants with five or more licenses must then use FCC Form 159- C (" Continuation Sheet") for the remainder of their licenses. License numbers should be identified by typing "WX" (radio service code), followed by the market designator (MEA), followed by the market number (001- 173), and the frequency block (blocks A and B). An example of a correct license number would be "WXMEA001- A" or “WXMEA120- B.” The radio service code, market designator, market number, and frequency block designations are listed in Attachment A and Attachment A1.
