Guam, File No. 00183-CW-L-97 Saipan Communications, Inc., (Saipan) Market B493F, Northern Marianas, File No. OOI86-CW-L-97 After reviewing the applications, filed by Saipan and Toto, the Division announces that it is prepared to grant the long form applications, upon the timely payment of the remaining five (5) percent down payment due on the F block licenses. Such payment must be received by the Commission within ten (10) business days of the date of this Public Notice (i.e., by March 21,2000). If the applicants fail to pay the remaining down payment by the March 21,2000 deadline, the applicants will be allowed to make payment within ten (10) business days (i.e. April 4,2000) after the payment deadline provided that it also pays a late fee equal to five percent of the amount due. See 47 C.F.R. § 1.2109(a). In addition to the payment, the applicants must also inform the Commission if they wish to participate in the Commission's installment payment plan. If the applicants elect to participate in the installment payment plan and timely notifies the Commission, a Note, Security Agreement, and financing statements (i.e., the UCC-1 Forms) and other related documentation commemorating the installment payment obligations, and the Commission's security interest in the licenses, will be sent to the applicants. They must then execute and return these documents to the Commission within ten (10) business days from the date of receipt of the documents. The applicants are responsible for payment of all costs associated with the preparation and recordation of the financing statements. In the event that an applicant elects not to participate in the Commission's installment payment plan, the applicants must make full payment of all monies due for the licenses within ten (10) business days of the issuance of this Public Notice (i.e., by March 21,2000) or full payment along with a late fee equal to five percent of the amount due by the late payment deadline of April 4, 2000. If an applicant fails to pay at least the second down payment by the late payment deadline of April 4, 2000. it will be considered in default on its licenses and subject to the applicable default payments.
