This Order addresses the “Motion for Extension of Time To Comply with the Final Stages of the Cable Services Bureau’s April 16, 1999 Order” filed by CSC Holdings, Inc. (“ Cablevision”). WXTV License Partnership, G. P., licensee of WXTV (TV), Channel 41, Paterson, New Jersey (“ WXTV”) filed a response to Cablevision’s request for additional time and Cablevision filed a reply. To secure a uniform channel position for WXTV throughout the New York ADI, the Bureau directed Cablevision to comply with the statutory channel positioning requirements with respect to 21 cable systems within 45 days of the release of the Order and to come into compliance within six months for the 17 remaining systems. 1 As discussed below, we grant the extension of time. 2. Cablevision requests an extension of time to complete repositioning of WXTV to Channel 41, a process which Cablevision asserts would involve the removal of traps in the homes of at least 80,000 subscribers. During this conversion, Cablevision states that it also intends to install interdiction devices in its New York systems and that the entire process can be completed by March 31, 2000. In its response, WXTV requests that Cablevision be required to move WXTV to Channel 41 on the remaining systems after the Nielsen ratings period on March 30- 31, 2000, regardless of the state of the interdiction installation. 3. In view of the foregoing, we grant Cablevision’s motion for extension of time with the limitation that it complete the repositioning of WXTV on the remaining systems by March 31, 2000. Should Cablevision not be able to complete the installation of interdiction technology by March 31, 2000, Cablevision shall take whatever steps necessary to insure the carriage of WXTV on Channel 41 by March 31, 2000. We agree as requested by WXTV that carriage should remain in its current configuration until March 31, 2000. Accordingly, the motion for extension of time filed by CSC Holdings, Inc., is granted to the extent discussed herein. 1 See WXTV License Partnership, G. P., 14 FCC Rcd 6482 (1999). 1 Federal Communications Commission DA 00- 97 2 4.
