On March 30, 2001, Cable & Wireless, USA, Inc. (C& W) filed an application requesting authority under section 214( a) of the Communications Act of 1934, 47 U. S. C. § 214( a), and section 63.71 of the Federal Communications Commission's (Commission) rules, 47 C. F. R. § 63.71, to discontinue C& W’s provision of United Telnet (T- Net) service, an inbound and outbound, switched and dedicated access long distance toll service. The application states that C& W has offered T- Net service since August 1997. C& W provides T- Net service to 1,028 customers throughout the United States, excluding Hawaii, Alaska, Arkansas and South Dakota. C& W states that in recent months, network and other expense associated with the provision of T- Net service have become increasingly costly, resulting in lost revenue to C& W and increased costs to T- Net customers. The application states that, in August/ September 2000, C& W notified T- Net customers of the availability of an optional C& W service to which T- Net customers could migrate and receive comparable service at competitive rates, priced at or below the rates for T- Net; customers who chose to migrate would not be subject to a minimum monthly usage charge or set- up/ installation fees. The application also states that on February 1, 2001, C& W gave notice to all affected customers of its proposed discontinuance of T- Net service by ordinary mail delivered through the U. S. Postal Service, and that on March 29, 2001, C& W submitted a copy of the application to the Secretary of Defense and the Public Utility Commission and Governor of each State in which discontinuance is proposed. In accordance with section 63.71( c) of the Commission's rules, the applicat ion will be deemed to be automatically granted on the 31st day after the release date of this notice without any Commission notification to the applicant, unless prior to that date the Commission has notified the applicant t hat t he grant will not be aut omat ic.
