The Commission considers herein the Notice of Proposed Rule Making (“ Notice”), (DA 01- 335), released February 9, 2001, issued in response to a petition for rule making filed by M. Terry Carter and Douglas Sutton, Jr. d/ b/ a Tugart Communications (“ petitioner”), proposing the allotment of FM Channel 236A to Young Harris, Georgia, as that community’s first local FM transmission service. Comments in support of the allotment were filed by the petitioner. 1 No other comments were received. 2. In light of the expressions of int erest in providing a first local FM t ransmission service t o Young Harris, Georgia, we will allot Channel 236A to that community, as requested. 3. As stated in the Notice, Channel 236A can be allotted to Young Harris in conformity with the minimum distance separation requirements of Section 73.207( b)( 1) of the Commission’s Rules, utilizing city reference coordinates at 34- 56- 00 NL and 83- 50- 54 WL. 4. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective June 22, 2001, the FM Table of Allotments, Section 73.202( b) of the Commission's Rules, IS AMENDED to include Young Harris, Georgia, as follows: City Channel No. Young Harris, Georgia 236A 1 In its comments petitioner advises that as daytime only Station WZCM( AM) is licensed to Young Harris, the requested allotment of FM Channel 236A would provide that community with its first full- time service, and not its first local aural service as stated in the Notice. 1 Federal Communications Commission DA 01- 1149 2 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6. A window period for filing applications for Channel 236A at Young Harris, Georgia, will not be opened at this time. Instead, the issue of opening the allotment for auction will be addressed by the Commission in a subsequent Order. 7.
