Before the Allocations Branch for consideration is the Notice of Proposed Rule Making (“ Notice”) (DA 01- 496), released February 23, 2001, issued in response to a petition for rule making filed on behalf of Copper Valley Radio (“ petitioner”), proposing the allotment of Channel 290A to Morenci, Arizona, as that community’s first local aural transmission service. No comments were filed by the petitioner or any other party. 2. As stated in the Notice, a showing of continuing interest is required before a channel will be allotted. It is the Commission’s policy to refrain from making an allotment to a community absent an expression of interest. Therefore, petitioner’s proposal will be dismissed since no party expressed an interest in applying for Channel 290A at Morenci, Arizona. 1 3. Accordingly, IT IS ORDERED, That the request filed on behalf of Cooper Valley Radio (RM- 10071), to allot Channel 290A to Morenci, Arizona, IS DISMISSED. 4. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 1 As Morenci is located within 320 kilometers (199 miles) of the U. S.- Mexico border, concurrence of the Mexican government to the proposed allotment of Channel 290A at that community was requested. As a result of our action herein, the Commission will notify the Mexican government accordingly. 1 Federal Communications Commission DA 01- 1183 2 5.
