S. C. § 214) and Section 63.18 of the Commission’s rules (47 C. F. R. § 63.18), the International Bureau’s Telecommunications Division approves the application filed by Southwestern Bell Communications Services, Inc. d/ b/ a Southwestern Bell Long Distance (“ SBCS”) requesting authority to provide international facilities- based and resale services originating the states of Kansas and Oklahoma and terminating at all international points. This application covers traffic originating in the states of Kansas and Oklahoma, which are two of the in- region states of SBC Communications Inc. (" SBC") and SBC’s subsidiaries, including SBCS. SBCS's international Section 214 Application, therefore, is a companion to the joint application of SBC, Southwestern Bell Telephone Company, and SBCS (collectively "SWBT"), for authorization to provide in- region, interLATA services in the states of Kansas and Oklahoma, pursuant to Section 271 of the Act (47 U. S. C. § 271). No comments were filed on SBCS's international Section 214 Application, which was put on public notice on December 13, 2000 (See Non- Streamlined International Application Accepted for Filing, Public Notice, FCC File No. ITC-214- 20001130- 00713, DA 00- 2813 (rel. Dec. 13, 2000)). Today the Commission approved SWBT’s Section 271 application (See Joint Application by SBC Communications Inc., Southwestern Bell Telephone Company, and Southwestern Bell Communications Services, Inc. d/ b/ a Southwestern Bell Long Distance for Provision of In- Region, InterLATA Services in Kansas and Oklahoma, CC Docket No. 00- 217, Memorandum Opinion and Order, FCC 01- 29 (rel. January 22, 2001). Because SWBT has received Section 271 authority to provide in- region, interLATA services in the states of Kansas and Oklahoma, we grant SBCS authority to provide international facilities- based and resale services originating in Kansas and Oklahoma and terminating at all international points. Grant of the international Section 214 Application will serve the public interest by increasing competition in international services, expanding the range of new and innovative services, and allowing for more efficient use of existing international 1 DA 01- 127 2 telecommunications facilities. This grant is subject to SBCS's compliance with the Commission's international dominant carrier regulations on the following three routes where SBCS has affiliations with foreign carriers that the Commission has not yet determined to lack market power: U. S.- Belgium, U. S.- Denmark, and U. S.- South Africa. SBCS shall remain subject to dominant carrier regulation on the U. S.- Hungary route pending the Commission's determination of its request for nondominant treatment on that route, which is based on SBC's divestment of its ownership interest in MATAV Rt., the incumbent carrier in Hungary. SBCS requests nondominant treatment for the following routes where it has affiliations with foreign carriers: U. S.- Canada, U. S.- Czech Republic, U. S.- France, U. S.- Germany, U. S.- Great Britain, U. S.- Lithuania, U. S.- Netherlands, U. S.- Norway, and U. S.- Switzerland. SBCS has provided sufficient evidence that the foreign carriers with which SBCS is affiliated on these routes lack sufficient market power on the foreign end of the routes to affect competition adversely in the U. S. market. SBCS will therefore be regulated as nondominant in its provision of services on all routes except the U. S.- Belgium route, the U. S.- Denmark route, the U. S.- South Africa route, and the U. S.- Hungary route. This grant of the international Section 214 Application will become effective upon the effective date of the Commission Order granting authorization to SWBT to provide in- region, interLATA services in the states of Kansas and Oklahoma.
