On April 25, 2000, Skytel Communications, Inc. (“ Skytel”) filed the above-captioned application. On May 19, 2000, Stratophone, LLC (“ Stratophone”) filed a request to dismiss the application 1 on the ground that the proposed transmitter is within 800 kilometers (497 miles) of Stratophone’s existing transmitter in violation of section 22.813( a) of the Commission’s rules. 2 Subsequently, on May 23, 2000, Skytel withdrew its application, rendering Stratophone’s request moot. 2. Accordingly, IT IS ORDERED that, pursuant to sections 4( i) and 309( d) of the Communications Act, as amended, 47 U. S. C. §§ 154( i) and 309( d), and section 0.331 of the Commission's rules, 47 C. F. R. § 0. 331, the request to dismiss filed by Stratophone, LLC on May 19, 2000, IS DISMISSED as moot.
