C. 20554 DA 01- 1591 July 5, 2001 SIERRA PACIFIC COMMUNICATIONS COMPANY NOTIFIES COMMISSION THAT IT NO LONGER SEEKS TO MAINTAIN EXEMPT TELECOMMUNICATIONS COMPANY STATUS UNDER THE PUBLIC UTILITY HOLDING COMPANY ACT NSD File No: ETC 00- 08 On February 18, 2000, Sierra Pacific Communications (SPC or Applicant), pursuant to section 34( a)( 1) of the Public Utility Holding Company Act of 1935 (PUHCA), 15 U. S. C. § 79 et seq., as amended by section 103 of the Telecommunications Act of 1996, Pub. L. No. 104- 104, filed an application requesting a Federal Communications Commission (Commission or FCC) determination that it is an “exempt telecommunications company” (ETC). SPC was deemed to be an ETC upon receipt of said application. 1 On May 22, 2001, SPC filed a Notification and Request to Terminate its ETC status. 2 Pursuant to 47 CFR § 1.5006( c), ETCs can terminate their status by notifying the Commission that they do not want to remain a ETC. The rules do not provide for a comment period for ETC terminations. See 47 CFR § 1.5007. Accordingly, the Commission is hereby notified and recognizes that SPC has terminated its ETC status.
