Before the Bureau are joint motions to withdraw petition and vacate order filed June 7, 2001 by TCI Cablevision of Oregon, Inc., d/ b/ a TCI of Tualatin Valley, Inc. (“ TCI- O”) and the Metropolitan Area Communications Commission (“ MACC”), TCI- O and the City of Sherwood, OR and TCI- O and the City of Wilsonville, OR with respect to TCI- O’s November 22, 1999 Petition for Reconsideration of the Memorandum Opinion and Order in TCI Cablevision of Oregon, Inc., d/ b/ a TCI of Tualatin Valley, Inc., DA 99- 2227 (Cab. Serv. Bur. Released October 21, 1999). 1 The Memorandum Opinion and Order addressed an appeal of a 1997 local rate order issued by the MACC. As these motions involve communities represented by MACC at the time it issued its rate order, we are consolidating the motions. 2 2. In their motions, TCI- O, MACC and the Cities state they have now reached an acceptable resolution of this matter and, therefore, the Memorandum Opinion and Order and the Petition for Reconsideration have effectively been rendered moot. TCI- O, the MACC and the Cities request that the Memorandum Opinion and Order be vacated and the Petition for Reconsideration be dismissed without benefit of substantive Commission review. This withdrawal resolves all pending BST rate matters involving TCI- O, the MACC and the Cities of Sherwood, OR and Wilsonville, OR. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Petition and Vacate Order filed June 7, 2001 by TCI Cablevision of Oregon, Inc. d/ b/ a TCI of Tualatin Valley, Inc., and the Metropolitan Area Communications Commission, the Joint Motion to Withdraw Petition and Vacate Order filed June 7, 2001 by TCI Cablevision of Oregon, Inc. d/ b/ a TCI of Tualatin Valley, Inc and the 1 Cite to MO& O: 14 FCC Rcd 17685 (Cab. Serv.
