Before the Commission are joint motions to withdraw appeals of local rate orders of the South Hills Area Council of Governments (“ SHACOG”) filed June 19, 2001 by TCI of Pennsylvania, Inc. (TCI- P) and SHACOG, TCI- P and the Borough of Greentree, PA (“ Borough”), and TCI- P and the Township of South Park, PA (“ Township”). As these motions all involve communities included in one or more of the SHACOG rate orders at the time the orders were enacted, 1 we are consolidating the motions. 2. TCI- P has filed appeals and requests for emergency stay of local orders adopted by the SHACOG. In its motions, the parties state that they have now reached an acceptable resolution of these matters. The parties together ask that the appeal, request for emergency stay as well as all subsequent filings related to these proceedings be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. This withdrawal resolves all pending local rate matters involving TCI- P and SHACOG, the Borough and the Township. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed June 19, 2001 by TCI of Pennsylvania, Inc., and the South Hills Area Council of Governments, the Joint Motion to Withdraw Appeals of Local Rate Orders filed June 19, 2001 by TCI of Pennsylvania, Inc. and the Borough of Greentree, and the Joint Motion to Withdraw Appeals of Local Rate Orders filed June 19, 2001 by TCI of Pennsylvania, Inc., and the Township of South Park ARE GRANTED and the appeals and stay requests filed by TCI of Pennsylvania, Inc.
