 On  November  3,  2000,  USA  Media  Group,  LLC  filed  a  Petition  for  Preemption  and  Declaratory 
 Ruling  pursuant  to  Section  253  of  the  Communications  Act.  By  Public  Notice,  DA  00-  2869,  released 
 December  22,  2000,  the  Commission  established  dates  for  comments  and  reply  comments.  By  letter  dated 
 January  22,  2001,  USA  Media  Group,  LLC  advised  the  Commission  of  changed  circumstances 
 unanticipated  at  the  time  of  its  filing  and  withdrew  its  petition. 


 Accordingly,  the  CS  Docket  No.  00-  252  proceeding  IS  TERMINATED  and  the  comment  period 
 IS  CLOSED.
