This biennial filing requirement for commercial broadcast station licensees has resumed in calendar year 2001. On or before August 1, 2001, an ownership report (FCC Form 323, September 2000 Edition) should be filed by licensees whose commercial radio or television stations are located in the States of California, Illinois, North Carolina, South Carolina and Wisconsin. At two- month intervals throughout 2001, the remaining commercial licensees will file their stations’ biennial ownership reports. Subsequent Public Notices will be issued advising these licensees of their scheduled filing dates. FCC Form 323 (September 2000 Edition) is to be used in submitting the commercial biennial ownership report. This form may be obtained by writing to the Commission’s Form Distribution Center, 9300 East Hampton Drive, Capital Heights, Maryland 20743, or by telephoning 1- 800- 418- 3676 and leaving a request on the answering machine provided for this purpose. FCC Form 323 is also available through the Internet. To retrieve this form by using the Internet, access the FCC’s Web Site, http:// www. fcc. gov, and click on the Forms link. FCC Form 323 (September 2000 Edition) is also available by using the Mass Media Bureau’s Consolidated Database System (CDBS) electronic filing system. This system provides commercial licensees with the ability to fill out the biennial FCC 323’s on- line via the Internet from the Mass Media Bureau’s Web Site, http:// www. fcc. gov/ mmb, and to file them electronically with the Commission. Licensees intending to file electronically should consult the “CDBS Electronic Filing System User’s Guide” prior to completion and submission of their FCC 323’s. Internet access to the CDBS requires a user to have, at a minimum, a browser such as Netscape version 3.04 or Internet Explorer version 3.51. Commercial licensees are strongly encouraged to file their biennial FCC 323 electronically. Through the CDBS, a commercial licensee can access a prefilled version of the biennial FCC 323 that 1 it manually filed in calendar year 1999, update and correct the previous ownership information contained therein, and file the revised 2001 biennial ownership report electronically. Where no changes have occurred with respect to the previous ownership information, the commercial licensee need only certify that the statements and information in its 2001 FCC 323 are true, correct and complete. Generally, biennial ownership reports require the payment of a fee, which is currently $50.00 for each biennial ownership report. For licensees submitting FCC 323’s electronically, a prefilled FCC Form 159 (Remittance Advice) can be generated and payment made electronically by use of a credit card. Otherwise, the required fee payment and a completed FCC Form 159 (Remittance Advice) must be delivered to the Commission’s lock box bank in Pittsburgh, Pennsylvania. See Section 0.401( b) of the Commission’s Rules. A listing of the required fee code, a copy of FCC Form 159 and the address to which payment (and any manually filed FCC Form 323’s) should be mailed or otherwise delivered is also set forth in the Mass Media Services Fee Filing Guide (September 2000 Edition), which is obtainable from the Commission’s Form Distribution Center.
