On June 22, 2001, Broadband Office Communications, Inc. (Applicant or BBOC), located at 2730 Sand Hill Road, Suite 150, Menlo Park, CA 94025, filed a defective application requesting authority under section 214( a) of the Communications Act of 1934, 47 U. S. C. § 214( a), and section 63.71 of the Federal Communications Commission's (FCC or Commission) rules, 47 C. F. R. § 63.71, to discontinue its domestic telecommunications services. On July 13, 2001, BBOC filed a curative supplement. The application states that BBOC is a non- dominant provider of interstate common carrier telecommunications services which include outbound long distance (1+) service, inbound toll- free number service, travel service, directory assistance service, audio conferencing, operator services, dedicated leased line, and DSL service. BBOC is requesting authority to discontinue the provision of these services in thirty- six (36) major metropolitan markets of the United States. Specifically, BBOC intends to discontinue service in the following geographic areas: Arizona, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, Nevada, New York, North Carolina, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, Washington, Washington, DC, and Wisconsin. The application states that on May 9, 2001, the parent company of BBOC, BroadBand Office, Inc. (BBO), filed for protection under Chapter 11 of the Bankruptcy Code in the U. S. District Court of Delaware. On June 21, 2001, BBO sent a second notice to all customers indicating that all services will be discontinued. In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified Applicant that the grant will not be automatically effective. The FCC will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity is otherwise adversely affected.
