S. C. § 214( a), and section 63.71 of the Federal Communications Commission's (FCC or Commission) rules, 47 C. F. R. § 63.71, to discontinue its domestic telecommunications services. Specifically, DSLnet requests authority to discontinue its interstate special access DSL service for high- speed internet access in certain markets in the following states: Arkansas, California, Florida, Georgia, Indiana, Iowa, Idaho, Kansas, Maine, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New York, Ohio, Oklahoma, Oregon, Pennsylvania, South Carolina and Texas. The application indicates that on July 17, 2001, DSLnet provided its customers written notice of its planned discontinuance in accordance with Section 63.71( a)( 5)( i) of the Commission’s rules. Applicant states that in addition to the regulation’s required language, the notice explains that DSLnet is striving to identify alternative providers that would be able to provide comparable service in a manner that avoids, or at least minimizes, service disruption and inconvenience. Applicant explains that the proposed discontinuance is interstate in nature, and it does not propose to discontinue any of its intrastate services, nor does it seek to cancel or amend any existing state or federal license or tariff. In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified Applicant that the grant will not be automatically effective.
