On July 25, 2001, 2 nd Century Communications, Inc. (2 nd Century or Applicant), located at 11921 Rockville Pike, Suite 500, Rockville, MD 20852, filed an application requesting authority under section 214( a) of the Communications Act of 1934, 47 U. S. C. § 214( a), and section 63.71 of the Federal Communications Commission’s (FCC or Commission) rules, 47 C. F. R. § 63.71, to discontinue providing domestic telecommunications services. Specifically, Applicant seeks authority to discontinue providing voice and data services in the following states (as well as the District of Columbia): California, Florida, Georgia, Illinois, Maryland, Massachusetts, Nevada, New York, North Carolina, Ohio, Pennsylvania, Tennessee, Texas, Virginia and Wisconsin. The application indicates that as a result of both inadequate revenues and financing, Applicant was forced to curtail its provision of services beginning in December 2000. In June of this year, Applicant states that it filed for bankruptcy and is presently winding down its operations through a Chapter 11 filing. In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be aut omat ically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified Applicant that the grant will not be automatically effective. The FCC will normally authorize proposed discontinuances of service unless it is shown that customers or other end users would be unable to receive service or a reasonable substitute from another carrier, or that the public convenience and necessity is otherwise adversely affected.
