C. 20554 In the Matter of ) ) Amendment of Section 73.202( b), ) MM Docket No. 00- 20 Table of Allotments, ) RM- 9733 FM Broadcast Stations. ) (Paris and Mount Pleasant, Texas ) ) REPORT AND ORDER (Proceeding Terminated) Adopted: August 15, 2001 Released: August 24, 2001 By the Chief, Allocations Branch: 1. In response t o a pet it ion filed by Carephil Communicat ions, Inc. (“ Carephil”), the Commission has before it for consideration the Notice of Proposed Rule Making, 15 FCC Rcd 2199 (2000), requesting the reallotment of Channel 270C2 from Paris, Texas, to Mount Pleasant, Texas, and modification of its license for station KBUS( FM) to specify Mount Pleasant as its community of license. Carephil filed comments in response to the Notice in this proceeding continuing to support the requested change of community of license. No other comments were received in response to the Notice. 2. Although Carephil initially filed comments restating its support of an allotment at Mount Pleasant, on July 31, 2001, Carephil submitted comments withdrawing its interest in the requested change of community of license from Paris to Mount Pleasant. Carephil states that since the submission of its petition for rule making, Carephil has secured authorizaton to transfer the license for Station KBUS to East Texas Broadcasting, Inc. and has subsequently consummated that transaction. 1 Carephil further states that East Texas Broadcasting has indicated that it is not interested in pursuing the reallocation requested in the Petition for Rule Making. As stated in the Notice, a showing of continuing interest is required before a channel will be allotted. It is the Commission's policy to refrain from making an allotment to a community absent an expression of interest. In this case, since Carephil has stated that it no longer intends to pursue the reallotment of a channel from Paris to Mount Pleasant, we shall dismiss the proposal. 3. In view of the above, IT IS ORDERED, That the Petition for Rule Making filed by Carephil 1 See BALH- 20010320AAM. 1 Federal Communications Commission DA 01- 1999 2 Communications (RM- 9733), requesting the reallotment of Channel 270C2 from Paris, Texas, to Mount Pleasant, Texas, IS DISMISSED. 4.
