C. 20554 DA 01- 2043 News media information 202/ 418- 0500 Fax- On- Demand 202/ 418- 2830 Internet: http:// www. fcc. gov ftp. fcc. gov Released: October 22, 2001 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS THIRTEEN C AND F BLOCK BROADBAND PERSONAL COMMUNICATIONS SERVICES (PCS) LICENSES TO SUMMIT WIRELESS, LLC Auction Event No. 35 Report No. AUC- 35 (Auction No. 35) On July 27, 2001 and August 22, 2001, the Wireless Telecommunications Bureau announced that it was prepared to grant applications for sixty- two (62) licenses and four (4) licenses, respectively, to winning bidders in the C and F Block Broadband Personal Communications Services (PCS) Auction (Auction No. 35), provided that each applicant made full and timely payment of the remaining balance of its winning bid( s). 1 The July 27 Prepared to Grant Public Notice included twelve (12) licenses for which Summit Wireless LLC (“ Summit Wireless”) was the high bidder. The payment deadline for licenses on the July 27 Prepared to Grant Public Notice was August 10, 2001. 2 The Commission received full and timely payment, as required by section 1.2109( a) of the Commission’s rules, for fifty (50) licenses by that date. Accordingly, by a Public Notice released August 22, 2001, 3 the Commission announced the grant of those fifty (50) C and F Block Broadband PCS licenses. Summit Wireless failed to pay the balance of its winning bid( s) in a lump sum by August 10, 2001, and was required to pay the remaining balance, plus a late fee equal to five percent of the amount due, by August 24, 2001. 4 The Commission received full and timely payment plus the five- percent late fee, as required by section 1.2109( a) of the Commission’s rules, for Summit Wireless’ twelve (12) licenses. The August 22 Prepared to Grant Public Notice included one (1) license for which Summit Wireless was the high bidder. Summit Wireless paid for its license by applying a $10,848,800 portion of Qualcomm Incorporated’s (“ Qualcomm”) Auction Discount Voucher. 6 Qualcomm transferred that portion of its Auction Discount Voucher to Summit Wireless for that purpose. 7 Accordingly, by this Public Notice, we announce the grant of the thirteen (13) C and F Block Broadband PCS licenses listed in Attachment A. We grant these licenses pursuant to Section 309( a) of the Communications Act of 1934, as amended, 47 U. S. C. § 309( a), and section 0.331 of the Commission's Rules, 47 C. F. R. § 0.331, because it will serve the public interest, convenience and necessity.
