 By  the  Chief,  Allocations  Branch: 
 1.  The  Allocations  Branch  has  before  it  a  petition  for  rulemaking  filed  by  Word  of  God 
 Fellowship,  Inc.  (“  petitioner”),  requesting  the  reallotment  of  Television  Channel  29  from  Decatur  to  Plano, 
 Texas.  1  Decatur,  1990  U.  S.  Census  population  4,252  persons,  has  no  other  television  stations  or 
 allotments.  Katherine  Pyeatt  filed  comments  opposing  the  petition  on  the  ground  that  it  would  remove  the 
 sole  local  television  service  from  the  community.  We  received  no  other  comments. 


 2.  As  stated  in  the  Appendix  to  the  Notice  of  Proposed  Rulemaking,  “the  proponent  of  a 
 proposed  allotment  is  also  expected  to  file  comments  even  if  it  only  resubmits  or  incorporates  by  reference 
 its  former  pleadings.  It  should  also  restate  its  present  intention  to  apply  for  the  channel  if  it  is  allotted  and, 
 if  authorized,  to  build  a  station  promptly.  Failure  to  file  may  lead  to  denial  of  the  request.”  Since  we  have 
 received  one  comment  in  opposition  and  no  comments  in  support  of  the  proposal,  we  will  dismiss  the 
 petition  for  rulemaking. 


 3.  A  copy  of  this  Order  will  be  served  on  the  petitioner,  or  its  counsel  or  consultant,  as

 1  This  petition  was  originally  filed  as  a  request  to  reallot  an  unbuilt  station  and  change  transmitter  site, 
 which  was  returned  because  it  proposed  the  removal  of  the  sole  local  transmission  service.  A  petition  for 
 reconsideration  of  this  action  was  held  in  abeyance  pending  outcome  of  the  Digital  Television  proceeding. 
 Commission  records  now  show  that  the  licensee  has  built  the  station  and  been  granted  modifications  which  place 
 its  transmitter  site  within  the  city  limits  of  Dallas,  Texas,  which  has  obviated  the  need  for  a  change  of  transmitter 
 site.  Petitioner’s  petition  for  reconsideration  is  therefore  dismissed  as  moot.
