On December 15, 2000, Nextel Communications, Inc. (Nextel), filed a petition to deny the application for consent to assign the license (Application File No. 0000230759) for Specialized Mobile Radio (SMR) Station WPEF823 from Clarus Communications LLC (Clarus) to All Points Communications, Inc. (All Points). Nextel has agreed to withdraw its petition to deny against the assignment application incidental to an Asset Exchange Agreement (Agreement) relating to the relocation of SMR Station WPEF823 from the Upper 200 channels of the 800 MHz band. Nextel, Clarus and All Points have filed a copy of the Agreement and their respective certifications along with the withdrawal request. The Division has reviewed the proposed Agreement and certifications. The Division hereby approves the withdrawal of the petition to deny and grants consent to Application File No. 0000230759, which authorizes the assignment of the license for SMR Station WPEF823 from Clarus to All Points, in accordance with sections 0.331, 1.935, 1.939, and 1.948 of the Commission’s rules. 1 Action by Deputy Chief, Commercial Wireless Division, Wireless Telecommunications Bureau.
