 Adopted:  September  25,  2001  Released:  September  28,  2001 
 By  the  Chief,  Consumer  Protection  and  Competition  Division,  Cable  Services  Bureau: 
 1.  On  August  8,  2001,  TCI  of  Tacoma,  Inc.  (“  TCI-  T”)  and  the  City  of  Tacoma,  Washington 
 (“  City”)  filed  with  the  Commission  a  joint  motion  to  withdraw  an  appeal  of  a  local  rate  order  adopted  by 
 the  City.  In  its  motion,  TCI-  T  states  that  it  has  now  reached  an  acceptable  resolution  of  this  matter  with 
 the  City.  TCI-  T  and  the  City  together  request  that  the  appeal  and  request  for  emergency  stay,  as  well  as 
 all  subsequent  filings  related  to  these  proceedings  be  withdrawn  and  dismissed  without  benefit  of 
 substantive  Commission  review.  This  withdrawal  resolves  all  pending  basic  service  tier  matters 
 involving  TCI-  T  and  the  City. 


 2.  Accordingly,  IT  IS  ORDERED  that  the  Joint  Motion  to  Withdraw  Appeal  of  Local  Rate 
 Order  filed  by  TCI  of  Tacoma,  Inc.  and  the  City  of  Tacoma,  Washington  IS  GRANTED  and  the  appeal 
 and  emergency  stay  request  ARE  DISMISSED. 


 3.  This  action  is  taken  pursuant  to  authority  delegated  by  Section  0.321  of  the  Commission's 
 rules.  47  C.  F.  R.  §  0.321.
