On September 5, 2001, Sammons Communications of New Jersey, Inc.(“ Sammons”) filed with the Commission motions for leave to withdraw appeals of local rate orders for the above captioned communities adopted by the State of New Jersey Board of Public Utilities (“ BPU”). As these motions all involve communities included in one or more of the BPU rate orders, we are consolidating the motions. 2. Sammons had filed appeals for the communities of Pleasantville (East) and Vineland, New Jersey on December 15, 1999 and Pleasantville (West), New Jersey on December 20, 1999 of local rate orders adopted by the BPU on November 15, 1999 and November 18, 1999 respectively. In its motions, Sammons state that the current operator of the systems at issue has reached an agreement with the BPU resolving the issues related to these proceedings and that further action by the Commission is unnecessary. 3. Accordingly, IT IS ORDERED that the Motions for Leave to Withdraw Appeal of Local Rate Order filed on September 5, 2001 by Sammons Communications of New Jersey, Inc. for the communities of Pleasantville East, NJ, Vineland, NJ and Pleasantville West, NJ ARE GRANTED and the appeals filed by Sammons in the above captioned proceeding ARE DISMISSED. 4.
