At the request of Alamo Public Telecommunications Council (" Alamo"), licensee of noncommercial station KLRN- TV, NTSC channel *9, San Antonio, Texas, the Commission has before it the Notice of Proposed Rule Making, 15 FCC Rcd 9460 (2000), proposing the substitution of DTV channel *8 for station KLRN- TV's assigned DTV channel *20. Alamo and The University of Houston System (" UHS"), the licensee of noncommercial station KUHT( TV), Houston, Texas, filed comments. 1 Alamo filed responsive comments. No other comments were filed. 2. We believe the public interest would be served by substituting DTV channel *8 for DTV channel *20 since it will allow KLRN- TV, a noncommercial educational licensee, which relies on public funding, to avoid unnecessary and costly construction expenses. DTV channel *8 can be allotted to San Antonio, Texas, as proposed, in compliance with the principle community coverage requirements of Section 73.625( a) at coordinates (29- 19- 38 N. and 98- 21- 17 W.). Since San Antonio is located within 275 kilometers of the U. S.- Mexican border, concurrence of the Mexican government has been obtained for this allotment. In addition, we find that this channel is acceptable under the 2 percent criterion for de minimis impact that is applied in evaluating requests for modification of initial DTV allotments under Section 73.623( c)( 2) for Station with the following specifications: DTV DTV power Antenna DTV Service State & City Channel (kW) HAAT (m) Pop. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective November 26, 2001, the DTV Table of 1 UHS filed comments stating that it does not oppose Alamo's channel substitution so long as it does not cause interference to KUHT's NTSC channel *8, Houston, Texas, during the transition period, as well as KUHT's eventual DTV operation on channel *8. In response, Alamo submitted an engineering statement that demonstrates that KLRN's proposed operation on channel 8 will not cause interference to the present NTSC operation of KUHT on channel 8. 1 Federal Communications Commission DA 01- 2326 2 Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. San Antonio, Texas *8, *16, 30c, 38, 39, 48, 55, 58 4. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, Alamo Public Telecommunications Council shall submit to the Commission a minor change application for a construction permit (FCC Form 304) specifying DTV Channel *8 in lieu of DTV Channel *20 for station KLRN- TV. 5.
