S. C. § 214) and section 63.18 of the Commission’s rules (47 C. F. R. § 63.18), the International Bureau Telecommunications Division grants the application filed by Southwestern Bell Communications Services, Inc. d/ b/ a Southwestern Bell Long Distance (“ SBC or Applicant”) for authority to provide international service originating in the states of Arkansas and Missouri. Specifically, Applicant requests authority to provide international facilities- based and resale services between all points in the states of Arkansas and Missouri, and all international points except countries listed on the Commission’s exclusion list. The application covers traffic originating in the states of Arkansas and Missouri, which are two of the “in- region” states of SBC. The international section 214 application is a companion to the joint application of SBC for authorization to provide in- region, interLATA service in the states of Arkansas and Missouri, pursuant to section 271 of the Communications Act (47 U. S. C. § 271) (see Joint Application by SBC Communications Inc., Southwestern Bell Telephone Company, and Southwestern Bell Communications Services, Inc. d/ b/ a Southwestern Bell Long Distance to provide In- region, InterLATA Services in Arkansas and Missouri). No comments were filed on the international application, which was put on public notice on October 2, 2001 (see Non-Streamlined International Applications Accepted for Filing, FCC File No. ITC- 214- 20010919- 00474, Public Notice, DA 01- 2279 (rel. October 2, 2001)). On November 16, 2001, the Commission approved SBC’s section 271 joint application (see Joint Application by SBC Communications Inc., Southwestern Bell Telephone Company, and Southwestern Bell Communications Services, Inc. d/ b/ a Southwestern Bell Long Distance pursuant to Section 271 of the Telecommunications Act of 1996 to Provide In- region, InterLATA Services in Arkansas and Missouri), CC Docket No. 01- 194, Memorandum Opinion and Order, FCC 01- 338, rel. November 16, 2001. Because SBC has received section 271 authority to provide 1 in- region, interLATA service in the states of Arkansas and Missouri, we grant SBC authority to provide the services for which it requests authority in its application; international facilities- based and resale services pursuant to sections 63. 18( e)( 1), (e)( 2) and (e)( 4) of the Commission’s rules, originating in the states of Arkansas and Missouri and terminating at all international points except countries listed on the Commission’s exclusion list. Grant of the international section 214 application will serve the public interest by increasing competition in international services, expanding the range of new and innovative services and allowing for more efficient use of existing international telecommunications facilities. This grant of authority, as agreed to by Applicant, is subject to Applicant’s compliance with the Commission's international dominant carrier regulations as specified below on the following routes where Applicant has affiliations with foreign carriers that the Commission has not yet determined lack market power: (1) the U. S.- Belgium route, the U. S.- Denmark route, and the U. S.- South Africa route, for international facilities- based service; and (2) the U. S.- Belgium route, the U. S.- Denmark route, and the U. S.- South Africa route, for international resale service (except to the extent Applicant serves these routes solely by reselling the international switched services of unaffiliated U. S. facilities- based carriers). We grant Applicant’s request for nondominant classification on all other routes where Applicant has affiliations with foreign carriers. Applicant has demonstrated that these foreign carriers lack sufficient market power on the foreign end of the routes to affect competition adversely in the U. S. market. In sum, SBC will be classified as nondominant in its provision of U. S. international services on all routes except the U. S.- Belgium route, the U. S.- Denmark route, and the U. S.- South Africa route. This grant of the international section 214 application will become effective upon the effective date of the Commission Order granting authorization to SBC to provide in- region, interLATA services in the states of Arkansas and Missouri.
