C. 20554 DA 01- 2726 News media information 202/ 418- 0500 Fax- On- Demand 202/ 418- 2830 Internet: http:// www. fcc. gov ftp. fcc. gov Released: November 21, 2001 WIRELESS TELECOMMUNICATIONS BUREAU ANNOUNCES IT IS PREPARED TO GRANT FIVE C AND F BLOCK BROADBAND PERSONAL COMMUNICATIONS SERVICES (PCS) LICENSES UPON FULL AND TIMELY PAYMENT Auction Event No. 35 Report No. AUC- 35 (Auction No. 35) On January 26, 2001, the Federal Communications Commission completed the auction of 422 licenses in the C and F Block Broadband PCS Auction. 1 After a preliminary review of the FCC long- form applications (FCC Form 601), applications for 418 licenses were accepted for filing. 2 By this Public Notice, the Wireless Telecommunications Bureau (“ Bureau”) announces that it is prepared to grant the five (5) licenses listed in Attachment A to this Public Notice, upon the full and timely payment of the remaining balance of the applicant's winning bids. Such payment must be received by the Commission within ten (10) business days after the date of this Public Notice (i. e., by December 6, 2001). See 47 C. F. R. §§ 1.2109( a), 24.711( a)( 2), 24.716( a)( 2). If the winning bidder fails to pay the balance of its winning bids in a lump sum by the applicable deadline, as specified by the Commission, it may pay the remaining balance within ten (10) business days after the payment deadline (i. e., by December 20, 2001), provided that it also pays a late fee equal to five percent of the amount due. See 47 C. F. R. §§ 1.2109( a), 24.711( a)( 2), 24.716( a)( 2). If the winning bidder listed in Attachment A fails to pay the balance of its winning bids by the late payment deadline of December 20, 2001, it will be in default and subject to applicable default payments. See 47 C. F. R. §§ 1.2104( g), 1.2109( c), 24.708( b). Such applicant will be assessed default penalties as prescribed by sections 1.2104( g), 1.2109( c), and 24.708( b) of the Commission's rules. See 47 C. F. R. §§ 1.2104( g), 1.2109( c), 24.708( b). Payment Instructions All payments must be made in U. S. currency in the form of a wire transfer. See 47 C. F. R. § 1.2107( b). Eastern Time, December 20, 2001, along with the five- percent late fee). The applicant should allow sufficient time for the wire transfer to be initiated and for the transmission to be completed prior to the deadline. On the same business day that the applicant pays the balance due to Mellon Bank, the applicant must fax a completed FCC Form 159 to Mellon Bank at (412) 209- 6045 at least one hour prior to placing the order for the wire transfer. On the FCC Form 159, the applicant must use the same FCC Taxpayer Identification Number (TIN) used on its FCC Form 601. When completing FCC Form 159 (February 2000 Version), the applicant must type the auction number, “35,” in Block( s) 28A and 28B (“ FCC Code 1”). The applicant also must type the applicable license numbers in Block( s) 29A and 29B (“ FCC Code 2”) of FCC Form 159. License numbers should be identified by typing “CW” (radio service code), followed by the market designator (BTA), followed by the market number (004- 493), and the frequency block (blocks C1- 5 and F). An example of a correct license number would be “CWB004C4” or “CWB181F.” The market designator, market number, and frequency block designations are listed in Attachment A. Form 159 provides sufficient boxes to list only two licenses. The applicant must then use FCC Form 159- C (“ Continuation Sheet”) for the remainder of its licenses.
