Heritage Cablevision, Inc. d/ b/ a TCI of Central Iowa (“ TCI- CI”) filed with the Commission On June 26, 1997 an appeal of local rate order adopted by the City of Clive, Iowa (“ City”). TCI- CI also filed a request for emergency stay on July 2, 1997. 2. On November 19, 2001, TCI- CI and the City filed a joint motion to withdraw appeals of local rate orders. In its motion, TCI- CI states that it has now reached an acceptable resolution of this matter with the City. TCI- CI and the City requests that the appeal, request for emergency stay, as well as all subsequent filings related to these proceedings be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. This withdrawal resolves all pending BST rate matters before the FCC involving TCI- CI and the City. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeals of Local Rate Orders filed by Heritage Cablevision, Inc. d/ b/ a TCI of Central Iowa and the City of Clive, Iowa IS GRANTED and the appeal and emergency stay ARE DISMISSED. 4.
