On November 13, 2001 Time Warner Cable (“ TWC”) filed with the Commission an appeal of local rate order adopted by the Board of Commissioners of Cabarrus County, North Carolina (“ County”) on October 22, 2001 and a request for sanctions. 2. In a Motion to Withdraw filed on December 19, 2001, TWC states that the County has adopted a new order approving the basic service tier rate. Therefore, TWC requests that the appeal and request for sanctions be dismissed. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw filed by Time Warner Cable is IS GRANTED and the Appeal of Local Rate Order and Request for Sanctions filed on November 13, 2001 IS DISMISSED. 4.
