At the request of West Central Illinois Educational Telecommunications Corporation (" West Central Illinois"), an applicant for a new television station to operate on channel *65, the Commission has before it the Notice of Proposed Rule Making, 17 FCC Rcd 2317 (2002), proposing the substitution of DTV channel *36 for channel *65 at Springfield. West Central Illinois filed comments stating its intention to amend its pending application to specify DTV channel *36, if allotted. 1 No other comments were received. 2. We believe the public interest would be served by allotting DTV channel *36 at Springfield since it would permit West Central Illinois to provide the community with its first local noncommercial DTV service. DTV channel *36 can be allotted to Springfield, Illinois, as proposed, in compliance with the principle community coverage requirement of Section 73.625( a) at coordinates 39- 36- 50 N. and 89- 38- 58 W. In addition, we find that this channel is acceptable under the 2 percent criterion for de minimis impact that is applied in evaluating requests for modification of initial DTV allotments under Section 73.623( c)( 2) with the following specifications: 1 West Central Illinois filed its petition for rule making pursuant to the provisions outlined in the Commission's Public Notice (" Public Notice") released on November 22, 1999, DA 99- 2605. In that Pubic Notice the Commission announced a window filing opportunity to allow persons with certain pending requests for new analog (NTSC) television stations to modify their requests to eliminate technical conflicts with digital television (DTV) stations and to move from channels 60 through 69. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective June 24, 2002, the DTV Table of Allotments, Section 73.622( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Springfield, Illinois *36, 42, 44, 53 4. IT IS FURTHER ORDERED, That effective June 24, 2002, the TV Table of Allotments, Section 73.606( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Springfield, Illinois 20+, 49-, 55+ 5. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, West Central Illinois Educational Telecommunications Corporation shall submit to the Commission an amendment to its application for a construction permit (FCC Form 340) specifying DTV Channel *36 in lieu of channel *65 at Springfield, Illinois. 6.
