On February 2, 2002, the American Radio Relay League, Incorporated (“ ARRL”) filed a Petition for Reconsideration of the Commission’s action in the Report and Order in the above captioned proceeding. ARRL seeks reconsideration of the portion of the Report and Order which addresses the Commission’s authority to authorize unlicensed operation pursuant to 47 U. S. C. § 301( a). They state that the Commission has no jurisdiction to authorize the operation of unlicensed devices that have significant potential to cause interference to licensed radio services. Oppositions to ARRL’s petition are due May 15, 2002. Replies to oppositions are due May 27, 2002. 2. On May 7, 2002, the working groups in IEEE Project 802 (the “IEEE 802 WWGs”) filed a Request for Extension of Time seeking to extend the deadline to file oppositions and replies to May 31, 2002 and June 28 2002; respectively. The IEEE 802 WWGs state that the additional time is required to prepare a thorough and meaningful response to the issues raised in ARRL’s Petition for Reconsideration. 3. We believe that providing more time will enable the IEEE 802 WWGs and other interested parties to submit additional information that will be beneficial to the record in this proceeding. Furthermore, we believe that the brief delay caused by extension of the filing deadlines will not impose a burden on the Petitioner. 1 Federal Communications Commission DA 02- 1162 2 4. Accordingly, IT IS ORDERED that the time for filing oppositions to the Petition for Reconsideration in the above captioned proceeding IS EXTENDED to May 31, 2002. IT IS FURTHER ORDERED that the time for filing replies IS EXTENDED to June 28, 2002. This action is taken pursuant to the authority found in Sections 4( i) of the Communications Act of 1934, as amended, 47 U. S. C. § 154( i) and pursuant to Sections 0.31, 0.241 and 1.46 of the Commission's Rules, 47 CFR §§ 0.31, 0.241 and 1.46. FEDERAL COMMUNICATIONS COMMISSION Edmond J.
