C. 20554 In the Matter of Improving Public Safety Communications in the 800 MHz Band Consolidating the 800 MHz Industrial/ Land Transportation and Business Pool Channels ) ) ) ) ) ) ) WT Docket 02- 55 Order Extending Time for Filing of Reply Comments Adopted: May 17, 2002 Released: May 17, 2002 By the Chief, Public Safety and Private Wireless Division, Wireless Telecommunications Bureau: 1. On May 13, 2002, the Industrial Telecommunications Association (ITA) filed a Request for Extension of Time (Request) in the captioned proceeding, asking that the current date set for the filing of reply comments, June 4, 2002, be extended by ninety days. ITA, in its Request, points to the large number and the complexity of the more than 200 filings in this proceeding. It suggests that a reply comment period longer than the currently allotted thirty days is necessary to guarantee adequately responsive reply comments. 2. It is the policy of the Commission that extensions of time are not routinely granted. 1 Although we agree with ITA that the complexity of issues present in this proceeding warrants a moderate extension of the reply comment deadline, we are mindful of our resolve to move swiftly to address the problem of interference to 800 MHz public safety communications. 2 As a result, we believe that the requested ninety- day extension is too lengthy. Given that we believe that an extension of time would afford the parties in this proceeding the opportunity to develop a more comprehensive and responsive record, we find that grant of an extension of the time for the filing of reply comments is warranted. We further believe that the more appropriate duration for such extension is 30 days. 3 3. ACCORDINGLY, IT IS ORDERED that the ITA Request for Extension of Time IS GRANTED, to the extent stated herein and IS DENIED in all other respects; and that the time for filing reply comments in the captioned proceeding IS EXTENDED until JULY 8, 2002. FEDERAL COMMUNICATIONS COMMISSION 1 See 47 C. F. R. § 1.46( a). 2 See Improving Public Safety Communications in the 800 MHz Band; Consolidating the 800 MHz Industrial/ Land Transportation and Business Pool Channels, WT Docket No. 02- 55, Notice of Proposed Rule Making, FCC 02- 81, ¶ 3 (rel. Mar. 15, 2002). 3 Given that the thirtieth day is a Federal holiday, we believe it is prudent to extend the filing deadline to July 8, 2002. 1 Federal Communications CommissionFCC 01-[ Click to enter order number] 2 D’wana R.
