C. 20554 In the matter of Applications for Consent to the Transfer of Control of Licenses Comcast Corporation and AT& T Corp., Transferors To AT& T Comcast Corporation, Transferee ) ) ) ) ) ) ) ) ) ) ) ) MB Docket No. 02- 70 ORDER EXTENDING FILING DEADLINE Adopted: May 24, 2002 Released: May 28, 2002 By the Chief, Media Bureau: 1. The Commission has received a Motion for Extension of Time from Media Access Project, Consumer Federation of America, and other consumer groups (collectively, “MAP”). On April 29, 2002, MAP filed a Petition to Deny the above- referenced applications. On May 21, 2002, the Applicants filed an Opposition to this Petition to Deny. Replies to the Applicants’ Opposition are due on May 29, 2002. MAP has requested a one- week extension of the reply deadline pursuant to Section 1.46 of the Commission’s Rules. In its request, MAP states that the Applicants filed a lengthy Opposition which will require more than one week to address because of MAP’s limited staff resources. MAP also notes that the intervening holiday imposes additional hardship in meeting the May 29 deadline. Accordingly, MAP seeks a one- week extension of the reply comment deadline until June 5, 2002, so that it can fully address the Opposition. 2. We believe that the public interest would best be served by granting an extension of the reply deadline. This extension will apply to any party who has filed a Petition to Deny in the instant proceeding. A one- week extension of the reply deadline will allow parties who have filed Petitions to Deny to better respond to the Applicants’ Opposition. This, in turn, will assist the Commission in its decision- making and resolving the various issues raised in this proceeding. 3. We also conclude that MAP’s extension of time request does not require us to “stop” the informal 180- day clock that the Commission uses as a benchmark for action on proposed transactions. Although the extension will delay our receipt of reply pleadings, we do not expect that this delay will materially impede our review of the proposed transaction given the early stage of this proceeding, the volume of comments received and the shortness of the extension period. 1 Federal Communications Commission DA 02- 1254 2 4. Accordingly, IT IS ORDERED that the Motion for Extension of Time filed by MAP IS GRANTED. 5. IT IS FURTHER ORDERED that the deadline for filing replies to Oppositions to Petitions to Deny in this proceeding IS EXTENDED to June 5, 2002. FEDERAL COMMUNICATIONS COMMISSION W. Kenneth Ferree Chief, Media Bureau 2
