At the request of Community Television, Inc. (" Community"), an applicant for a new television station to operate on channel *41 at Georgetown, South Carolina, the Commission has before it the Notice of Proposed Rule Making, 17 FCC Rcd 5794 (2002), proposing the substitution of DTV channel *38 for channel *41 at Georgetown. 1 Community filed comments restating its continuing interest in applying for DTV channel *38, if allotted. No other comments were received. 2. We believe the public interest would be served by allotting DTV channel *38 since the channel substitution would eliminate the potential for channel *41 interference to station WIS- DT, channel 41 at Columbia, South Carolina, while permitting Community to provide Georgetown with its first local noncommercial DTV service. DTV channel *38 can be allotted to Georgetown, South Carolina, as proposed, in compliance with the principle community coverage requirement of Section 73.625( a) at coordinates 33- 25- 58 N. and 79- 16- 16 W. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) 1 Community filed its petition for rule making pursuant to the provisions outlined in the Commission's Public Notice (Public Notice) released on November 22, 1999, DA 99- 2605. In that Public Notice the Commission announced a window filing opportunity to allow persons with certain pending requests for new analog (NTSC) television stations to modify their requests to eliminate technical conflicts with digital television (DTV) stations and to move from channels 60 through 69. Community submitted in its petition that the use of channel *41 operating in Georgetown would cause significant interference to station WIS- DT, channel 41, Columbia, South Carolina. 1 Federal Communications Commission DA 02- 1478 2 and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective August 15, 2002, the TV Table of Allotments, Section 73.606( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Georgetown, South Carolina -- 4. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective August 15, 2002, the DTV Table of Allotments, Section 73.622( b) of the Co Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Georgetown, South Carolina *38 5. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, Community Television Inc. shall submit to the Commission a minor change application for a construction permit (FCC Form 340) specifying DTV Channel *38 in lieu of TV Channel *41. 6.
