C. 20554 In the Matter of ) ) Spectrum Policy Task Force ) DA 02- 1311 Seeks Public Comment on Issues ) ET Docket No. 02- 135 Related to Commission’s ) Spectrum Policies ) ORDER Adopted: July 1, 2002 Released: July 2, 2002 By the Chief, Office of Engineering and Technology: 1. On June 6, 2002, the Spectrum Policy Task Force issued a Public Notice (“ Notice”) seeking public comment on various spectrum policy issues. 1 The Notice states that interested parties may file comments by July 8, 2002 and reply comments by July 23, 2002. On June 21, 2002, the Office of Engineering and Technology issued an order denying a motion for a 60- day extension of time in which to file comments. 2 On June 24, 2002, the New York State Office for Technology (“ NY OFT”) filed a motion for a 60- day extension of time in which to file comments and the Software Defined Radio (“ SDR”) Forum filed a motion for a 30- day extension of time in which to file comments. NY OFT asserts that it needs additional time because it is participating in two other Commission proceedings with similar comment deadlines 3 and due to the absence of personnel on scheduled annual vacations. SDR Forum asserts that it needs additional time in order to respond more fully to the questions presented in the Notice and also 1 “Spectrum Policy Task Force Seeks Public Comment on Issues Related to Commission’s Spectrum Policies,” ET Docket No. 02- 135, DA 02- 1311 (rel. June 6, 2002). 2 Order, ET Docket No. 02- 135, DA 02- 1456 (rel. June 21, 2002) (denying United Telecom Council’s motion for a 60- day extension in which to file comments). 3 We note that, after NY OFT filed its motion for extension of time, the comment period was extended in one of the two dockets it cited. See Order Extending Time for Filing Reply Comments, WT Docket 02- 55, DA 02- 1523 (rel. June 27, 2002). 1 Federal Communications Commission DA 02- 1558 notes that it is currently researching and writing an interim report on software- defined radio, which is due to the Commission in mid- July. 2. We hereby deny both NY OFT’s and SDR Forum’s motions for extension of time for the same reasons that we recently denied another party’s motion for extension of time in this matter. It is the policy of the Commission that extensions are not routinely granted. 4 Given the timeframe for the Spectrum Policy Task Force’s inquiry, as set forth in the Notice, an extension of time would not permit full consideration of all the public comments. As a result, the record in the proceeding must be developed according to the comment dates provided in the Notice. NY OFT and SDR Forum have not shown good cause for an extension of time. 3. Accordingly, IT IS ORDERED that, pursuant to authority delegated by Sections 4( i), 4( j), and 5( c) of the Communications Act, as amended, 47 U. S. C. Sections 154( i), 154( j), and 155( c), and sections 0.241 and 1.46 of the Commission's Rules, 47 C. F. R. Sections 0.241 and 1.46, the motions for extension of time filed by NY OFT and SDR Forum on June 24, 2002, are DENIED. FEDERAL COMMUNICATIONS COMMISSION Edmond J. Thomas Chief, Office of Engineering and Technology 4 47 C. F. R. § 1.46( a). 2
