On August 16, 1999 Lenfest Atlantic, Inc. d/ b/ a Suburban Cable (“ Suburban”), filed with the Commission an appeal of a local rate order issued by the New Jersey Board of Public Utilities (“ Board”) on July 23, 1999. In its rate order, the Board directed Suburban to recalculate its Form 1205 equipment rates and to issue refunds to subscribers. 2. On July 16, 2002, Comcast Cable Communications, Inc. (“ Comcast”) filed a request to dismiss the appeal filed by Suburban. In its letter, Comcast states that subsequent to the Board’s order, Suburban became a wholly- owned indirect subsidiary of Comcast. Comcast and the Board have agreed to a global settlement which resolved all of the outstanding issues that were the subject of the rate appeal. Therefore, Comcast requests that the appeal be dismissed. 3. Accordingly, IT IS ORDERED, that the request to dismiss filed by Comcast Cable Communications, Inc. IS GRANTED and the appeal filed on August 16, 1999 by Lenfest Atlantic, Inc. d/ b/ a Suburban Cable IS DISMISSED. 4. This action is taken pursuant to authority delegated by Section 0.283 of the Commission’s rules. 47 C. F. R. § 0.283.
