On March 26, 1997, TCI Cablevision of Contra Costa County (“ TCI- CC”) filed with the Commission an appeal of local rate order adopted by the City of Pleasant Hill, California (“ City”) on February 24, 1997 and a request for emergency stay on April 25, 1997. 2. In a Joint Motion to Withdraw Appeal of Local Rate Order filed on January 8, 2002, TCI-CC states that it has now reached an acceptable resolution of this matter with the City. TCI- CC and the City together request that the appeal, emergency stay, as well as all subsequent filings related to these proceedings be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal of Local Rate Order filed by TCI Cablevision of Contra Costa County and the City of Pleasant Hill, California IS GRANTED and the appeal filed on March 26, 1997 and emergency stay filed on April 25, 1997 ARE DISMISSED. 4.
