TCI Cablevision of Arcadia/ Sierra Madre (“ TCI- A”) filed with the Commission on March 20, 1997 two appeals of local rate orders adopted by the City of Arcadia, California (“ City”) on February 18, 1997. TCI- A also filed on February 9, 1998 a petition for reconsideration of Order, DA 98- 20 issued by the Cable Services Bureau on January 9, 1998. 2. In a Joint Motion to Withdraw Appeal of Local Rate Order filed on January 2, 2002, TCI- A states that it has now reached an acceptable resolution of this matter with the City. TCI- A and the City together request that the appeals, petition for reconsideration, as well as all requests for emergency stay and subsequent filings related to these proceedings be withdrawn and dismissed with prejudice and without benefit of substantive Commission review. 3. Accordingly, IT IS ORDERED that the Joint Motion to Withdraw Appeal of Local Rate Order filed by TCI Cablevision of Arcadia/ Sierra Madre and the City of Arcadia, California IS GRANTED and the appeals filed on March 20, 1997 and the petition for reconsideration filed on February 9, 1998 ARE DISMISSED. 4.
