 By  the  Chief,  Consumer  Protection  and  Competition  Division,  Cable  Services  Bureau: 
 1.  On  October  29,  2001,  Time  Warner  Cable  (“  TWC”)  filed  with  the  Commission  an  appeal 
 of  a  local  rate  order  adopted  by  the  Town  of  Cary,  North  Carolina  on  September  27,  2001. 


 2.  In  a  Motion  to  Withdraw  Appeal  of  Local  Rate  Order  filed  January  7,  2002,  TWC 
 requests  that  the  appeal  be  withdrawn  and  dismissed. 


 3.  Accordingly,  IT  IS  ORDERED  that  the  Motion  to  Withdraw  Appeal  of  Local  Rate 
 Order  filed  by  Time  Warner  Cable  IS  GRANTED  and  the  Appeal  filed  on  October  29,  2001  IS 
 DISMISSED. 


 4.  This  action  is  taken  pursuant  to  authority  delegated  by  Section  0.321  of  the 
 Commission’s  rules.  47  C.  F.  R.  §  0.321.
