C. 20554 News Media Information 202 / 418- 0500 Internet: http:// www. fcc. gov TTY: 1- 888- 835- 5322 DA 02- 2125 Released: August 29, 2002 WIRELESS TELECOMMUNICATIONS BUREAU GRANTS TWO 900 MHZ SPECIALIZED MOBILE RADIO MTA LICENSES AUCTION EVENT NO. 7 Report No. AUC- 7 (Auction No. 7) On June 14, 2002, the Wireless Telecommunications Bureau announced that it was prepared to grant the application for two (2) licenses in the 900 MHz Specialized Mobile Radio (SMR) Auction (Auction No. 7), provided that the applicant submitted its second down payment of five (5) percent of its winning bid by June 28, 2002. 1 The Commission received the applicant’s second down payment as required by Section 1.2110( g)( 2) of the Commission’s rules. The applicant is eligible to pay the remaining balance of its winning bids in installments. 2 Grant of each license is expressly conditioned upon timely execution and return of (1) a note documenting the applicant’s installment payment obligations, and (2) a security agreement commemorating the Commission's security interest in the license in the event of default. Grant is also conditioned upon the execution of the applicable financing statements (i. e. the UCC- 1 Forms) and payment of all costs associated with the preparation and recordation of the financing statements. Accordingly, final grant of each license is conditioned upon the full and timely performance of the licensee’s payment obligations under the installment plan. Failure to comply with these conditions in a timely manner for any license will result in automatic cancellation of the licenses. The Applicant will receive an original note, security agreement, and financing statements for each license granted, with instructions on completing, signing, and returning the documents to the Commission. Individual licenses will be issued to the licensee following receipt by the Commission of the note( s) and security agreement( s).
