At the request of KB Prime Media LLC (“ KB Prime”), an applicant for a construction permit for a new television station to operate on channel 56 at Wiggins, Mississippi, the Commission has before it the Notice of Proposed Rule Making, 17 FCC Rcd 12717 (2002), proposing the substitution of channel 46 for channel 56+ at Wiggins. 1 KB Prime filed comments supporting the channel change. No other comments were received. 2. We believe the public interest would be served by allotting channel 46 since it would permit KB Prime to provide the community of Wiggins with a second local television service. A staff engineering analysis indicates that channel 46 can be allotted to Wiggins with a minus offset consistent with the minimum distance separation requirements of Sections 73.610 and 73.698 of the Commission Rules at coordinates 30- 32- 32 N. and 89- 10- 40 W. 3. Accordingly, pursuant to the authority contained in Sections 4( i), 5( c)( 1), 303( g) and (r) and 307( b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204( b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective November 12, 2002, the TV Table of Allotments, Section 73.606( b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Wiggins, Mississippi 43-, 46- 1 KB Prime filed its petition pursuant to the provisions outlined in the Commission's Public Notice (" Public Notice") released on February 6, 2002, DA 02- 270. In that Public Notice, the Commission permitted applicants with certain pending requests for new analog television stations on channels 52- 59 to modify their requests because the Commission reallocated channels 52- 59 for new uses. See Reallocation and Service Rules for the 698- 746 MHz Spectrum Band (Television Channels 52- 59), Report and Order in GN Docket No. 01- 74, 17 FCC Rcd 1022 (2002). KB Prime filed a petition for rule making requesting the channel substitution in order to avoid dismissal of its application for channel 56. 1 Federal Communications Commission DA 02- 2368 2 4. IT IS FURTHER ORDERED, That within 45 days of the effective date of this Order, KB Prime Media LLC shall submit to the Commission a minor change application for a construction permit (FCC Form 301) specifying TV Channel 46- in lieu of TV Channel 56+. 5.
