 1.  In  response  to  a  petition  filed  by  Linda  Crawford  (“  Crawford”),  the  Commission  has  before  it  for  consideration  the  Notice  of  Proposed  Rule  Making  1  seeking  the  allotment  of  Channel  273A  at  Encinal,  Texas. 
 Crawford  filed  comments  in  which  she  reaffirmed  her  support  in  the  allotment  of  Channel  273A  at  Encinal.  No  other  comments  were  received  at  the  Commission  in  response  to  the  Notice. 


 2.  We  believe  that  the  public  interest  would  be  served  by  the  allotment  of  Channel  273A  at  Encinal,  Texas,  as  it  will  provide  the  community  with  an  its  first  local  FM  broadcast  service.  2  Channel  273A  can  be 
 allotted  to  Encinal  in  compliance  with  the  Commission's  minimum  distance  separation  requirements  with  a  site  restriction  12.5  kilometers  (7.8  miles)  northwest  of  the  community.  3  Since  Encinal  is  located  within  320 
 kilometers  of  the  U.  S.-  Mexican  border,  concurrence  of  the  Mexican  Government  has  been  obtained  for  the  allotment  of  Channel  273A  at  Encinal. 


 3.  Accordingly,  pursuant  to  the  authority  contained  in  Sections  4(  i),  5(  c)(  1),  303(  g)  and  (r)  and  307(  b)  of  the  Communications  Act  of  1934,  as  amended,  and  Sections  0.61,  0.204(  b)  and  0.283  of  the  Commission's 
 Rules,  IT  IS  ORDERED,  That  effective  November  12,  2002,  the  FM  Table  of  Allotments,  Section  73.202(  b)  of  the  Commission's  Rules,  IS  AMENDED  for  the  community  listed  below,  as  follows: 


 1  Encinal,  Texas,  17  FCC  Rcd  (MB  2002). 
 2  In  response  to  a  petition  filed  by  Charles  Crawford  the  Commission  issued  a  Notice  of  Proposed  Rule  Making 
 proposing  the  allotment  of  Channel  259A  at  Encinal.  See  16  FCC  Rcd  13915  (MM  2001).  Also,  on  September  27,  2001,  Jeraldine  Anderson  filed  a  petition  requesting  the  allotment  of  Channel  269A  at  Encinal  while  Katherine 


 Pyeatt  requested  the  allotment  of  Channel  286A  at  Encinal. 
 3  The  coordinates  for  Channel  273A  at  Encinal  are  28-  06-  40  and  99-  27-  15.

 4.  A  filing  window  for  Channel  273A  at  Encinal,  Texas,  will  not  be  opened  at  this  time.  Instead,  the  issue  of  opening  this  allotment  for  auction  will  be  addressed  by  the  Commission  in  a  subsequent  order. 
 5.  IT  IS  FURTHER  ORDERED,  That  this  proceeding  IS  TERMINATED.
