S. C. § 214( a), and section 63.71 of the Commission's rules, 47 C. F. R. § 63.71, to discontinue one of its domestic telecommunications services. The application indicates that Time Warner seeks authority to discontinue providing local exchange services to its approximately one thousand (1, 000) residential customers in the New York City area. Time Warner explains that in light of the changed financial market conditions, it intends to discontinue this service offering, and has made arrangements with Verizon, the incumbent local exchange carrier (ILEC), to transfer the affected customers over to its network. Time Warner also explains that it will not be automatically switch customers over to Verizon, and that the customers are free to contract with other competitive local exchange carriers (CLECs). Applicant states that all affected customers have been provided with notice of the proposed discontinuance, including the Commission’s required language. 1 In accordance with 47 C. F. R. § 63.71( c), the application will be deemed to be automatically granted on the thirty- first (31 st ) day after the release date of this notice, unless the Commission has notified Applicant that the grant will not be automatically effective. This proceeding is considered a "permit but disclose" proceeding for purposes of the Commission's ex parte rules. 2 Comments objecting to this application must be filed with the Commission by February 15, 2002. Such comments should refer to application file number W- P- D- 559. Comments should include specific information about the impact of this proposed discontinuance on the commenter, including any inability to acquire reasonable substitute service.
