On March 29, 2000, AT& T Broadband (“ AT& T”) filed with the Commission an appeal of local rate order adopted by the Mt. Hood Cable Regulatory Commission (“ MHCRC”) on February 28, 2000 for the above referenced Oregon communities. 2. On August 30, 2002, AT& T filed a Motion to Withdraw Appeal of Local Rate Order . In its motion, AT& T states that it has reached an acceptable resolution of this matter with the MHCRC. AT& T requests that the filings in this proceeding be dismissed with prejudice and without benefit of substantive Commission review. This withdrawal resolves all pending basic service tier rate matters before the Commission involving AT& T and the MHCRC. 3. Accordingly, IT IS ORDERED that the Motion to Withdraw Appeal of Local Rate Order filed by AT& T Broadband IS GRANTED and the appeal filed on March 29, 2000 IS DISMISSED. 4. This action is taken pursuant to authority delegated by Section 0.283 of the Commission’s rules, 47 C. F. R § 0.283.
